Terms of Use

By accessing or using the Services, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Services. If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

You must be at least 13 years old to use the Services. If you are under the age of majority in your jurisdiction, you may use the Services only with the involvement and consent of a parent or guardian. Some Services — including in-app purchases — may have additional age requirements.

Some Services require an account. For Algadon, your account is managed through Facebook authentication. You are responsible for:

• Keeping your login credentials secure.
• All activity that occurs under your account.
• Notifying us promptly if you suspect unauthorized use of your account.

We may suspend or terminate accounts that violate these Terms or that we reasonably believe are being used for fraud, cheating, or abuse.

When you purchase a license for one of our desktop applications (such as Blaze Media Pro, AutoImager, AudioEdit Deluxe, or any other Mystik Media classic software), we grant you a personal, non-exclusive, non-transferable, revocable license to install and use that software on a single computer for your personal or internal business use, subject to these Terms and any product-specific license terms presented at install time.

You may not:

• Copy, distribute, sell, sublicense, rent, or lease the software.
• Modify, decompile, disassemble, or reverse engineer the software, except to the extent that applicable law expressly permits it.
• Remove or alter copyright, trademark, or other proprietary notices.
• Circumvent any license, activation, or technical protection mechanism.

Additional installations require an additional license. Upgrades between major versions may require a paid upgrade. Trial or evaluation versions are licensed for evaluation only and may have time-limited functionality.

Algadon is provided as a free-to-play online game. We grant you a personal, non-exclusive, non-transferable, revocable license to access and play Algadon for your personal, non-commercial use, subject to these Terms.

Algadon includes virtual items, currency, characters, and content (collectively, “Virtual Goods”). You acknowledge that:

• Virtual Goods are licensed, not sold, and have no monetary value outside the game.
• Virtual Goods cannot be exchanged for cash or other consideration of value, and are non-transferable except through features we expressly provide in-game.
• Virtual Goods may be modified, reset, suspended, or discontinued at any time, including as part of game balance or anti-cheat actions.
• Real-money purchases of Virtual Goods are non-refundable except as required by law or as expressly stated in our refund practices.

Cheating, exploiting bugs, using unauthorized third-party tools, buying or selling accounts or Virtual Goods outside the game, and similar conduct are prohibited and may result in account suspension or termination, with no refund.

Prices for software licenses, upgrades, and Algadon Virtual Goods are listed at the point of purchase. All purchases are processed by our payment providers. By making a purchase, you authorize the charge to your selected payment method.

We use a try-before-you-buy model for our desktop software, so you can install and evaluate the trial before purchasing. Because of this, license purchases are generally non-refundable. If you experience a technical issue that prevents you from using a licensed product, please contact us — we will work with you in good faith to resolve it.

Algadon in-game purchases are non-refundable except as required by applicable law.

You agree not to use the Services to:

• Violate any applicable law, regulation, or third-party right.
• Attempt to interfere with, compromise, or disrupt the Services or their underlying infrastructure.
• Use bots, scrapers, automated tools, or unauthorized clients to access the Services.
• Reverse engineer or attempt to extract source code, algorithms, or unpublished data from the Services.
• Cheat, exploit bugs, manipulate game balance, or interfere with other players’ enjoyment of Algadon.
• Harass, abuse, threaten, or impersonate any person, or post content that is unlawful, obscene, or hateful.
• Buy, sell, transfer, or trade accounts or Virtual Goods outside mechanisms we provide.
• Collect personal information about other users without their consent.

The Services may allow you to submit content — chat messages, clan names, character names, support requests, and similar (“User Content”). You retain ownership of your User Content, but you grant Mystik Media a worldwide, royalty-free, non-exclusive license to host, store, reproduce, display, and use your User Content as needed to operate, improve, and promote the Services.

You are solely responsible for your User Content and represent that you have all rights necessary to submit it. We may, but are not obligated to, review, moderate, or remove User Content that violates these Terms or that we determine is otherwise objectionable.

The Services — including software, code, artwork, characters, stories, logos, and the “Mystik Media” and “Algadon” names — are owned by Mystik Media or its licensors and are protected by copyright, trademark, and other intellectual property laws. Except for the rights expressly granted in these Terms, no rights are granted by implication or otherwise.

The Services may link to or integrate with third-party services (such as Facebook, payment processors, and email providers). We are not responsible for the practices, content, or availability of third-party services, and your use of them is subject to their own terms and policies.

You may stop using the Services at any time. We may suspend or terminate your access to all or part of the Services — with or without notice — if you violate these Terms, if your use poses a risk to other users or to the Services, or if we discontinue a product. Upon termination, the licenses granted to you end and you must stop using the affected Services. Sections that by their nature should survive termination will survive.

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT ANY DATA — INCLUDING ALGADON CHARACTER OR VIRTUAL-GOOD DATA — WILL BE PRESERVED INDEFINITELY.

TO THE FULLEST EXTENT PERMITTED BY LAW, MYSTIK MEDIA AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUES, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE APPLICABLE PRODUCT IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR USD $50, WHICHEVER IS GREATER.

You agree to indemnify and hold Mystik Media and its affiliates harmless from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of your use of the Services, your violation of these Terms, or your violation of any rights of a third party.

These Terms are governed by the laws of the United States and the State of Florida, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Services will be resolved in the state or federal courts located in Florida, and you consent to the personal jurisdiction of those courts. If any provision of these Terms is held unenforceable, the remaining provisions will remain in full effect.

We may update these Terms from time to time. When we do, we will revise the “Effective” date at the top of this page, and material changes will be communicated through the Services or by email. Your continued use of the Services after the effective date constitutes acceptance of the updated Terms.
